directmeds.com (“Company,” “we,” “us”, or “directmeds.com”) and its affiliates own and operate the websites located at www.directmeds.com and may own or operate a mobile application (collectively, the “Platform”). Your access and use of the Platform, its content (“Content”), and any products, services, affiliated websites, software, or applications provided by us (collectively, the “Service”) are governed by these Terms and Conditions (“Terms” or “Agreement”).”
PLEASE READ THIS AGREEMENT CAREFULLY. In this Agreement, “you” and “yours” refer to the person using the Service. By clicking “I agree”, checking a box, making a purchase, continued use of this website, or otherwise affirmatively accepting these terms, you acknowledge that you have read, understood and agree to be bound by this agreement. If you do not agree, do not create an account or use the Service. You hereby grant agency authority to any party who accepts these Terms on your behalf.
IF YOU HAVE A MEDICAL EMERGENCY, IMMEDIATELY CALL YOUR DOCTOR OR DIAL 911. THE SERVICE IS NOT APPROPRIATE FOR ALL MEDICAL CONDITIONS OR CONCERNS.
Your access to and use of the Service is subject to this Agreement and all applicable laws. If you do not agree to be bound by this Agreement in its entirety, you are prohibited from using the Service (except to review these Terms).
We may revise this Agreement at any time at our sole discretion. Changes are effective upon posting to the Platform. Your continued use after changes are posted constitutes your acceptance of the modified Agreement. If you disagree with any changes, your sole remedy is to stop using the Service.
The Platform is not intended for children. You must be at least 18 years of age (or the age of majority in your jurisdiction, if higher) to use the Service. By using the Platform, you affirm that you are over the age of 18. Certain products may have additional age restrictions.
We are a technology platform that connects users with products and services offered by directmeds.com, third-party pharmacies (“Pharmacies”), medical groups (“Medical Groups”), and licensed healthcare providers (“Providers”).
We do not practice medicine. We do not control or interfere with the practice of medicine by Providers, who are solely responsible for the care they provide. We make no representations about the suitability, reliability, or accuracy of care provided by Medical Groups or Providers.
By using the Service, you are not entering a doctor patient relationship with directmeds.com. You may, however, enter such a relationship with the Providers. Medical Groups and Providers may send you messages, reports, or texts regarding your diagnosis or treatment; it is your sole responsibility to monitor and respond to them.
You are establishing a direct customer relationship with directmeds.com for use of the Platform and purchase of non-prescription products or non-medical services sold directly by us. Any personal or health information you provide is governed by our Privacy Policy.
SMS consent is optional. By opting in, you agree to receive marketing, transactional, informational, and conversational text messages from DirectMeds. Your mobile information is protected by HIPAA and will not be shared. Message frequency varies. Message and data rates may apply.

Certain products are sold on a subscription basis. Your payment method will be charged at the intervals described during checkout. You may cancel any time up to 48 hours before the next processing date by turning off auto-refill in your account portal. Contact [email protected] for assistance.
You will be charged the total subscription price (which may include pharmacy, medical group, and platform fees) every 30 days. You will receive advance notification 5–7 days prior to each charge.
Prescription products require a valid prescription from a Provider after a consultation through the Platform. By purchasing, you voluntarily waive your right to fill the prescription at any other pharmacy. Prescriptions are fulfilled by licensed third-party compounding pharmacies and are shipped to you by the applicable Pharmacy. Compounding pharmacies may vary by location and availability. Prescriptions do not use child resistant packaging.
The Service is available only in states where we offer it and only to eligible users who accept this Agreement. You represent that you are located in the same state as your shipping address when consulting with a Provider.
Telehealth services involve electronic delivery of healthcare and are not a substitute for in-person care. You must review and agree to the Patient Consent provided by the Medical Groups and Providers. We are a third party beneficiary of that consent.
You are responsible for maintaining your own hardware, software, and internet access to use the Service.
Please review our separate Privacy Policy for details on how we collect, use, and disclose your information. Protected health information (“PHI”) or other protected information will be handled in accordance with applicable law. De-identified information may be used as permitted by our Privacy Policy.
You must register and maintain accurate account information. You are responsible for keeping your username and password confidential and for all activity under your account. Notify us immediately at [email protected] of any unauthorized use. We use encryption for sensitive data but disclaim liability for security breaches beyond our reasonable control. You must log out after each session.
Subject to this Agreement, we grant you a limited, non-transferable, revocable license to access and use the Service for personal use only. All intellectual property rights in the Service and Content belong to us or our licensors. You may not remove copyright or trademark notices.
Any feedback, comments, or other information you submit (except PHI, which is handled per applicable law) is treated as non-confidential. You grant us a perpetual, royalty-free, worldwide license to use, modify, and display it for operating the Service.
You may not use the Service for any unlawful, harmful, or unauthorized purpose, including uploading viruses, spam, or infringing material; reverse engineering the Service; impersonation; or harassment. We reserve the right to suspend or terminate accounts for violations and to cooperate with law enforcement.
We may monitor use of the Service and remove any content that violates this Agreement or is otherwise objectionable in our sole discretion.
We are not responsible for third-party products, services, or websites linked through the Service. Your interactions with third parties (including Pharmacies, Medical Groups, and Providers) are solely between you and them. We disclaim all liability for third-party content or transactions. If you are a California resident, you waive California Civil Code § 1542.
All sales are subject to availability. We may correct pricing errors or cancel orders. You are responsible for all applicable taxes. Payment is processed through our third-party vendor. Risk of loss passes to you upon delivery to the carrier. Charges appear as “DM2*Directmeds”.
We may terminate or suspend your access at any time for any reason. Certain sections (security, IP, disclaimers, liability, arbitration, indemnification, etc.) survive termination.
The Service is provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties (express or implied) to the fullest extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant accuracy, completeness, or uninterrupted operation of the Service.
To the fullest extent permitted by law, neither we nor any third-party providers (including Medical Groups, Providers, or Pharmacies) will be liable for any indirect, incidental, consequential, special, or punitive damages. Our total liability shall not exceed U.S. $1,000. Claims must be brought within one (1) year.
You agree to indemnify, defend, and hold harmless directmeds.com, its affiliates, Medical Groups, Providers, Pharmacies, and all related parties from any claims, damages, or expenses arising from your use of the Service, breach of these Terms, or violation of law.

This Agreement constitutes the entire agreement between you and us and supersedes all prior agreements.
Any disputes arising out of or relating to this Agreement or the Service (including disputes with us, the Medical Groups, or Providers) will be resolved by binding individual arbitration under AAA rules in Salt Lake City, Utah. You waive any right to a jury trial or to participate in any class action or class-wide arbitration.
This Agreement is governed by the Federal Arbitration Act and the laws of the State of Utah without regard to conflict of laws. Venue for any non-arbitrated matters is in Salt Lake City, Utah. If any provision is unenforceable, the remainder remains in effect.
No agency, partnership, or joint venture is created. You may not assign your rights. We may assign ours. Certain parties (Medical Groups, Providers, Pharmacies) are third-party beneficiaries for specific provisions.
